Wellington Financial Services, Inc. is part of an organization that has been servicing the needs of the independent agents of Texas since 1988. The company has extensive experience managing programs on behalf of leading insurers and reinsurers. Wellington is very pleased to have been selected to manage First Mercury Insurance Company’s newly-enhanced program for Texas Non-Subscribers. First Mercury has an A.M. Best rating of A- (Excellent) and A.M. Best has assigned First Mercury the Financial Size Category of VIII.

The First Mercury program for Non-Subscribers is available to qualified producers on-line. Four different products are offered and each is designed to serve a specific market segment. A wide range of self-insured retentions and deductibles are offered.

One product offered is a unique insurance policy for small to medium-sized employers: the Primary Employer’s Advantage Policy with a Medical Expense Deductible. The policy provides employer’s liability insurance and it reimburses or indemnifies an employer’s benefit obligations under an Occupational Injury Benefit Plan (ERISA Plan). The deductibles offered range from $1,000 to $25,000. All claims are handled from the first dollar by Wellington Financial Services’ experienced claims personnel. An employer insured under the Primary Employer’s Advantage Policy (Ded) can have peace of mind knowing he or she will not have a deductible for any coverage other than Medical Expense. Wellington will handle all claims from the first dollar and the employer’s only obligation beyond the first notice of claim is to pay the medical expenses within the deductible after the medical expenses are approved and re-priced by Wellington.

Important Features — Accident Safeguard and Occupational Safeguard Policies:

  • Alternative Dispute Resolution Programs are mandatory and available at no charge. An employer’s existing dispute resolution program is acceptable subject to the insurance company’s prior approval.

  • Employee Occupational Injury Benefit Plans (ERISA Plans) are mandatory and available at no charge. An employer’s existing Plan is acceptable subject to the insurance company’s prior approval.
  • Alternative Dispute Resolution Programs are optional and available at no charge. An employer’s existing dispute resolution program is acceptable subject to the insurance company’s prior approval.

Important Features — All Policy Types with Employer’s Liability:

  • The Self-Insured Retention or Deductible does not reduce the Limit of Liability
  • Legal Defense costs do not reduce the Limit of Liability
  • The insurance company has the Duty to Defend any covered suit regardless of the size of the Self-Insured Retention or the size of the Deductible.
  • Bodily Injury Damages include Punitive or Exemplary Damages.
